Charlie Monfort, the 54-year-old co-owner of the Colorado Rockies, was arrested for allegedly driving while under the influence of alcohol on Monday night in Windsor. According to a police report obtained from the Windsor Police Department, local authorities pulled over Monfort’s truck just after 9:30 pm when they noticed that he was driving about 10 miles per hour above the speed limit.
When police asked Monfort if he had been drinking prior to driving, Monfort admitted to having about two beers. Although Monfort refused to submit to field sobriety testing after this admission, he did comply with a breath test after the officer read Monfort an expressed consent. The results of the breathalyzer test indicated that Monfort’s blood alcohol concentration (BAC) was 0.28, which is more than three times the legal limit of 0.08.
Upon failing the breathalyzer test, Monfort was arrested and booked into the Weld County Jail in Greeley, from which he was released the following morning on his own recognizance. The next court date in this DUI case has been scheduled for November 19, at which time the arraignment will take place.
Although the police report presents a strong case against Monfort, skilled defense lawyer can argue the following in an attempt to get the charges against Monfort reduced or potentially even dropped altogether:
- The breathalyzer had not been calibrated prior to being used to test Monfort’s BAC.
- The officer was not properly trained on how to use the breathalyzer.
- The breathalyzer results were inaccurate for some other reason (for example, maybe Monfort had regurgitated prior to the breath test, resulting in a much higher, inaccurate BAC reading).
- The officer failed to inform Monfort of his rights prior to arresting him.
