Shawn Pomrenke, one of the stars of Discovery Channel’s hit reality show “Bering Sea Gold: Under the Ice,” has recently been arrested for his second DUI and could, as a result, face some serious DUI penalties if he is ultimately convicted. According to the police report associated with this case, Pomrenke was in Nome, Alaska in November 2013 when he was reportedly driving at speeds in excess of 100 miles per hour. A traffic cop who witnessed the speeding and reportedly saw Pomrenke changing lanes without using his vehicle’s indicator pulled over the star on suspicion of reckless driving.

The police report goes on to explain that, upon pulling over Pomrenke and questioning him, the officer noted some distinct signs of alleged intoxication, including the smell of alcohol on Pomrenke’s breath, slurred speech and a general disorientation. Although it’s unclear if the traffic cop asked Pomrenke to submit to field sobriety testing (and, if so, whether Pomrenke refused to submit to this testing or outright allegedly failed it), the police report explains that Pomrenke submitted to a breathalyzer and reportedly blew a 0.156, which is nearly twice the legal limit of 0.08 in Alaska.

While Pomrenke was immediately arrested on suspicion of DUI, his car was also impounded, as it did not have an ignition interlock device installed on it (and, as part of the terms of probation for his first DUI case, Pomrenke was required to have such a device installed on all of the vehicles he operates). In that first DUI case, Pomrenke reportedly hit a pedestrian while operating his vehicle while under the influence of alcohol.

As the case against Pomrenke moves forward, it’s unclear how he and his attorneys plan to defend him against the DUI charges; however, depending on the facts of the case, it may be possible to allege that the BAC results were inaccurate because, for example, the device was not properly calibrated prior to use.
