INTERNET LURING

The internet never forgets, and neither will your neighbors

Few sex offense charges are as devastating as those involving children.

If you have been charged with child enticement, internet luring, or another internet-based sex offense involving a child, you are going through one of the most difficult times of your life.

The charges come with serious penalties, both criminally and socially. Alleged offenders may face jail time, job loss, and abandonment of family and friends. Fight charges of internet luring with the capable criminal defense team at the Law Offices of Andres Guevara.

Colorado Law on Internet Luring

A person can be charged with internet luring of a child if he uses an electronic network, such as text messaging, email, or the internet, to knowingly communicate explicit sexual conduct to a child under the age of 15 in an effort to persuade the child to meet for any purpose.

The defendant must be more than four years older than the child in question.

At issue with this law is the fact the government can charge you for meeting for any purpose, unlike child enticement, which requires sexual intent.

Navigating investigations and entrapment for Internet Luring

Many times, a non-profit organization such as the National Center for Missing and Exploited Children conduct investigations online, which are then turned over to law enforcement. Once turned over to law enforcement, a criminal investigation is initiated. However, evidence from a third party can be challenged.

In other cases, law enforcement officers pose online as children. In these cases, an entrapment defense may be appropriate.

An entrapment defense means an officer coerced a defendant into committing a crime that he would have otherwise not committed. When investigators coerce or entrap a defendant into committing a crime, the resulting charges can be vigorously contested and may be reduced or dismissed as a result.
