The most important thing to do if you’ve been charged with a DUI is to contact a DUI lawyer. Regardless of what you have said to the police or what tests you have agreed to or refused, you need and deserve legal representation from here on out. Without a DUI lawyer, your charges are not likely to be reduced or dropped. An attorney can and will speak on your behalf from here on out, decreasing your chances of incriminating yourself. He or she will also gather as much evidence as possible to portray your case in the most convincing way possible.

But what if I can’t afford an attorney?

Unfortunately, many people who have been charged with criminal offenses, such as a DUI, do not retain an attorney because they simply can’t afford one. However, this should never stop anyone, and here’s why.

Under the Sixth Amendment, all defendants are guaranteed the right to legal counsel in felony cases or misdemeanors that could result in incarceration. This means that if you do not have enough money to afford an attorney, you can be appointed a lawyer completely free of charge.

Once you have been arrested, you will be brought before a judge in court and will be read your charges. You will be asked whether you plead guilty or not guilty, and it is at this time that you can request an appointed lawyer. If you do so, you will most likely have to provide your financial information such as your income, debts, and assets to prove your financial hardship. The courts will decide if you qualify for an appointed lawyer. Even if you are employed, you may still qualify for a free appointed lawyer.

What type of punishment am I facing if I am convicted?

It is important to know what you may be up against if you have been charged with a DUI. Your punishment will depend on the circumstances: Is this your first, second, third, or fourth offense? What state were you in when you were charged with DUI? The answers to these questions will determine the amount you will have to pay in fines, how much time you will have to spend in jail, and whether or not you will be sentenced to time in prison.
